EB-4 Visa: Employment-Based Immigration Fourth Preference

The EB-1 visa is reserved for the following special immigrants:

• Physicians
• International Organization Employees
• Broadcasters
• Panama Canal Zone Employees
• Retired NATO-6 employees
• Spouses and children of Deceased NATO-6 employees
• Armed Forces Members
• Iraqi/Afghan Translators
• Iraqis who Have Assisted the United States
• Religious Workers

EB-4 Employment-Based Immigration Fourth Preference Visa Petitioning Process:

• The U.S. employer must file Form I-360, Petition for Amerasian, Widow(er) or Special Immigrant
• In special cases, you may be able to self-petition. Please see Form I-360 to see if you qualify.

Family Members of EB-4 Visa Holder:

• EB-4 visa  holders are allowed to bring their spouse and dependent and unmarried children under 21 years of age to the United States

EB-4 Broadcasters:

The International Broadcasting Bureau of the United States Broadcasting Board of Governors (BBG) or Radio Free Asia (RFA) and Radio Free Europe/Radio Liberty(RFE/RL) is allowed to petition an alien to work as a broadcaster for the BBG or for Radio Free Asia, INC (RFA) or Radio Free Europe/Radio Liberty, Inc. (RFE/FL) in the United States.

Each of the following qualifies as a “broadcaster” for EB-4 purposes:

• Producer
• Announcer
• Newscaster
• News analyst
• Analysis specialist
• News editor
• Reporter
• Translator
• Writer
• News broadcasting host

EB-4 Visa I-360 Petition for Broadcasters:

The BBG or grantee of the BBG (RFA or RFE/RL) must submit Form I-360 along with signed and dated documents containing the job title of the prospective employee along with all the duties and responsibilities, and information the aliens’s work experience. The BBG or BBG grantee must establish that the employee is qualified for the position and has the necessary skills for the broadcasting or broadcasting-related position.
